Jose W. Vega Law Firm, P.L.L.C. is a boutique law firm that specializes in Immigration Law, Criminal Defense, Deportation Defense, Federal and State Courts Litigation of Torts Jose W. Vega is also an immigration law specialist that is Board Certified by the Texas Board of Legal Specialization for Immigration and Nationality Law, and licensed to practice law in both New York and Texas.
Jose W. Vega has been practicing law since 1993. He is licensed by the U.S. Supreme Court, the U.S. Circuit Courts of Appeal for the 5th and 6th Circuits, various U.S. District Courts, the state of Texas, the state of New York, and the state of Louisiana. He is a member of the American Trial Lawyers Association and the American Immigration Lawyers Association.
The following are a few examples of the types of cases that we handle:
Types of Cases
1. Representation in Immigration Court and Federal Court of individuals that have been charged violating the immigration laws of the United States.
2. Representation in state and Federal criminal courts of individuals that have been charged with having committed an immigraiton related crime.
3. Representation of individuals in extradition proceedings.
4. Representation of individuals that need to litigate tort matters in State or Federal Court. Examples involve claims against Federal employees for wrongful or abusive conduct, false arrest, erroneous deportation, failure to perform duties and negligence.
5. Representation of individuals that want to apply for a U.S. visa or lawful permanent residence in the United States.
The following is a list of different procedures to obtain an immigration benefit.
1. H-1B visa: This is a visa for professionals. In order to qualify for an H-1B visa, the applicant must have a professional degree or its equivalent, and a job offer related to the applicant's degree. There is currently a limit of 65,000 H-1B visas granted each year. It is advisable that an applicant apply for an H-1B visa as early as possible in the year in order to avoid not having a visa available because of the limit.
2. E-2 visa: This is a visa for investors. In order to qualify for an E-2 visa, the applicant must be from a "treaty" country, and the applicant must invest a substantial amount in a new or existing business.
Most European and South American nationals qualify for an E-2 visa. The amount of the investment required depends on the type of business. My firm has obtained E-2 visas for investors of amounts from as low as $50,000 USD to as high as $90 million USD. In addition, employees(executives, managers, highly skilled) of companies that qualify for E-2 status can obtain an E-2 visa.
3. L-1A visa: This is a visa for executives and managers of multinational companies. The L-1A visa allows executives and managers of foreign companies to transfer to a U.S. subsidiary and work for that subsidiary. The U.S. subsidiary can be a newly created entity. The executive or manager must have worked for one year abroad prior to being eligible to transfer to the U.S. Executives and Managers with L-1A visa status can apply for their residency through a simplified process that does not require a prior approval by the Department of Labor. I have successfully created new U.S. subsidiaries of established foreign companies, and subsequently obtained a U.S. visa for the executives and managers of those foreign companies to allow them to come work for the U.S. entity. The size of the company can vary from small private companies to very large public companies.
4. O visa: This is a visa reserved for individuals of exceptional merit. We have successfully obtained O visas for doctors, researchers, performing artists, and athletes. The criteria used to approve an O visa is very restrictive. Only individuals of international fame in their professions will qualify for the O visa. The O visa is also commonly used by doctors with J visas in order to avoid the two year foreign residency requirement.
5. P visa: Professional Athletes that do not meet the O visa standard can obtain a P visa in order to play professional sports in the U.S.
6. H-2B visa: Employers that have a peak-load, seasonal, or one time occurrence need for non-professional employees can apply for an H-2B visa for temporary employees. We have successfully obtained H-2B visas for restaurants, catering companies, hotels, shipyards, welding companies, and construction companies. The visa will be approved for less than 1 year, and an extension can be requested up to 2 years.
7. H-2A visa: This visa is very similar to the H-1B visa, except that it is reserved for agricultural workers.
8. Lawful Permanent Residency through employment: In order to qualify for residency through employment, an employer must first obtain an approved labor certification application(PERM). In order to obtain an approved labor certification application, the employer must demonstrate a shortage of capable or willing U.S. workers vis-à-vis a recruitment process which requires advertising the position. There are exceptions to the labor certification process. For example, a professional whose work is in the interest of the U.S. may qualify for residency without a labor certification. This includes professionals whose work benefits the U.S., such as environmental scientists and structural engineers whose work benefits U.S. interstate commerce. In addition, executives and managers of multinational companies are exempt from the Labor Certification requirement. Also, professional athletes, performing artists, and scientists of exceptional merit and international fame are exempt from the labor certification process.
9. Lawful permanent residency through family members, K-1 visas for fiancées of U.S. citizens, K-3 visas for spouses of U.S. citizens.
10. Immigration Litigation: Representation of individuals in deportation proceedings in the Immigration Court and before the Board of Immigration Appeals. Representation of individuals in Federal District court in habeas and mandamus proceedings. Habeas Corpus proceedings are necessary to protect an individual?s constitutional rights. Mandamus proceedings are necessary to force the U.S. government to process a petition or application that has been unduly neglected by the government. In addition, I represent individuals in Federal Court under the Federal Tort Claims Act that are victims of abuse or negligence by the U.S. government.
11.Consular Processing: We represent individuals in proceedings before the U.S. Consulates abroad.
12. Formation and Advising of Business Entities: We form corporations, limited companies, and partnerships on behalf of investors and entrepreneurs. We advise regarding the best possible business entity to create with respect to the particular circumstances in each case. We advise regarding control of the entity, potential liability, tax issues, and investment issues. For example, if three individuals form a corporation, but one of the individuals has invested more money than the others, we can create and issue preferred shares for that individual which will guarantee that the individual will be able to obtain the additional value of his investment in the case of a sale or dissolution of the corporation.
The above examples are merely examples of the types of cases that we handle.
